These General Terms and Conditions ("Terms") govern your use of the AlpFresh website and the purchase of groceries and related services from AlpFresh AG, Bundesgasse 26, 3011 Bern, Switzerland ("AlpFresh", "we"). By placing an order, you agree to these Terms.
1. Scope
These Terms apply to all orders placed via alpfresh.ch or by telephone. Deviating terms of the customer are not accepted unless we agree in writing.
2. Eligibility
Orders may only be placed by persons aged 18 or over who reside in Switzerland or the Principality of Liechtenstein and have full legal capacity.
3. Orders and Contract Formation
The presentation of products on our website does not constitute a binding offer. By submitting an order you make a binding offer to purchase. A contract is formed when we send you an order confirmation by email.
4. Prices
All prices are quoted in Swiss Francs (CHF) and include Swiss VAT unless otherwise stated. Delivery charges are shown at checkout before you confirm your order.
5. Payment
Accepted payment methods include credit/debit cards, TWINT, PostFinance and invoice (subject to credit check). Payment is due at the time of order confirmation unless otherwise agreed.
6. Delivery
- We deliver throughout Switzerland during the delivery windows shown at checkout.
- Delivery times are estimates; delays due to weather, traffic or force majeure do not entitle the customer to cancel or claim damages.
- Risk of loss passes to the customer upon handover of the goods.
7. Right of Withdrawal
Because our products are perishable and quickly deteriorate, no statutory right of withdrawal applies to fresh food items. For non-perishable goods, you may return unopened items in original condition within 14 days at your own cost.
8. Product Quality & Complaints
Please inspect the goods immediately on delivery. Complaints regarding visible defects must be reported within 24 hours by phone at +41 31 560 51 54 or email at connect@groceryathome.store. We will replace defective items or refund the purchase price at our discretion.
9. Retention of Title
Goods remain the property of AlpFresh until full payment has been received.
10. Liability
AlpFresh is liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by Swiss law. Liability under the Product Liability Act remains unaffected.
11. Intellectual Property
All content on the website — including text, images, logos and design — is the property of AlpFresh or its licensors and may not be used without prior written consent.
12. Data Protection
The processing of personal data is governed by our Privacy Policy.
13. Amendments
We reserve the right to amend these Terms at any time. The version in force at the time of your order applies.
14. Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
15. Governing Law & Jurisdiction
These Terms are governed by Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Bern, Switzerland, subject to mandatory statutory provisions on consumer jurisdiction.
